IMPORTANT: Please read the following Cricket Refer a Friend ("Refer a Friend" or "Program") Terms & Conditions ("Terms and Conditions") that describe your participation in the Program. It is your responsibility to carefully read and to understand these Terms and Conditions.
- General
- Acknowledge that you have read and understand this Agreement and agree to these Terms and Conditions;
- Acknowledge that you are 18 years of age or older;
- Acknowledge that in no event is this Program available to persons under the age of 13;
- Acknowledge that if you are between 13 years and 18 years old, your legal guardian has reviewed and agrees to the Terms and Conditions;
- Agree to the terms of the Cricket Privacy Notice, www.cricketwireless.com/privacy; and
- Agree to Cricket's Wireless Terms and Conditions of Service, www.cricketwireless.com/terms, including its provisions regarding dispute resolution by binding individual arbitration.
This Program is separate and distinct from any other rewards or loyalty program previously offered by Cricket. Your participation in any such prior rewards or loyalty program is subject to the applicable terms and conditions of that program and not these Terms and Conditions.
Unless otherwise defined herein, capitalized terms used in these Refer a Friend Terms and Conditions have the meaning given to them in the Cricket Wireless Terms and Conditions of Service.
- Program Overview
- Refer A Friend is a program whereby Cricket customers are afforded an opportunity to earn an account credit, in an amount to be determined by Cricket in its sole discretion, by promoting Cricket wireless service.
- Only Cricket customers with an eligible online account, with at least 30 days' active service, via My Account and/or the myCricket app ( “Online Account”) may participate in the Refer a Friend Program ("Referrer").
- To participate in Refer a Friend, a Referrer sends a message to another person through SMS, Email, Facebook, Twitter, or other social media or sharing methods, with a unique link (“URL”) provided by Cricket ("Referee") inviting the Referee to join Cricket and earn an account credit. The Referrer is solely responsible for complying with all applicable laws in the sending of the message to Referee. At the request of Referee, Cricket may send a one-time text or email to the number or email address provided with a unique referral code. Message and data rates may apply. You can reply STOP to unsubscribe from Refer a Friend text messages or START to re-subscribe to Refer a Friend messages. You may unsubscribe from Refer a Friend email messages by clicking the unsubscribe link in the email. Message frequency varies. If you need help during this process, customer concerns can be resolved quickly, by calling our customer service department at 1-800-CRICKET (274-2538).
- Cricket will apply an account credit to the Referrer's and Referee's respective wireless accounts after both participants have met all of the following conditions as determined by Cricket in its sole discretion:
- The Referrer and Referee comply with all instructions provided by Cricket with respect to the Refer a Friend activity.
- The Referrer initiates a referral by following the Program instructions within their Online Account to create a message that sends a unique URL inviting Referee(s) to participate in the Program.
- The Referee must access the unique URL in the message from the Referrer and provide an email address to receive a unique 13-character referral code.
- The Referrer and Referee Cricket Wireless account cannot belong to the same person.
- The Referee must activate a new Cricket account with at least one new line on a qualifying rate plan, and create an Online Account to enter the unique 13-character referral code within 30 days of receiving the code.
- The Referee can enter the 13-character referral code via Cricket’s activation flow in-store, online, on device activation (“ODA”), or by calling Cricket customer service. The Referee can also after activation, create an Online Account to enter the unique 13-character referral code within 30 days of receiving the code.
- For a Referrer to be eligible for and receive account credit(s), Referrer and Referee must maintain their active Cricket accounts for a minimum of 60 days after Referee activates the new account.
- For a Referee to be eligible for and receive the account credit, Referrer must maintain an active Cricket account for a minimum of 60 days after Referee activates the new account.
- Referrer is eligible to receive only one account credit per Referee account created and maintained as set forth herein, regardless of the number of lines activated on the Referee account.
- Subject to satisfaction of the conditions set forth in this Section II and any other conditions herein, Cricket will apply an account credit to the Referrer’s and Referee’s respective Cricket accounts after 60 days of Referee’s active wireless service on a qualifying Cricket plan.
- A Referrer may earn up to ten (10) account credits per account per calendar year, provided they maintain their Cricket account during this period.
- A Referee may earn only one (1) account credit per account as a Referee; however, once a Referee becomes a Cricket customer, Referee can participate in the Program as a Referrer and be eligible for up to (10) account credits per account per calendar year provided they maintain their Cricket account during this period.
- Fraud
- Termination of or Changes to the Program
- Cricket Wireless reserves the right to change, discontinue, or terminate the Program - including but not limited to the terms, restrictions, and the ability to earn, claim and to use the account credits - at any time without notice.
- If Cricket chooses, a notification of a Program change, discontinuance, or termination may be sent to the email address you provided when you enrolled in the Program and/or by text message and/or picture/video message to your Cricket wireless number. We may also publicize the Program termination on the Program website. Cricket Wireless will not be responsible for failing to notify you of any Program change, discontinuance, or termination.
- You agree that your continued participation in the Program after any change shall be deemed to be your acceptance of the Program change. It is your responsibility to check the Program Terms and Conditions on the Program website regularly to determine whether the Program or these Program Terms and Conditions have been changed. If you do not agree to any Program change, you must immediately stop participating in the Program and advise Cricket Wireless that you are no longer participating.
- Limitation of Warranty
- THE PROGRAM IS BEING PROVIDED "AS IS" AND "AS AVAILABLE" WITH NO EXPRESS OR IMPLIED WARRANTY OR CONDITION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRICKET WIRELESS EXCLUDES ALL CONDITIONS, REPRESENTATIONS, WARRANTIES AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED INTO OR INCORPORATED INTO THIS AGREEMENT, WHETHER BY STATUTE, COMMON LAW OR OTHERWISE, WITH RESPECT TO THE PROGRAM, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND TERMS AS TO MERCHANTABILITY, SATISFACTORY QUALITY AND FITNESS FOR ANY PARTICULAR PURPOSE AND IMPLIED WARRANTIES AND TERMS ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
- YOU ACKNOWLEDGE THAT YOU HAVE NOT RELIED UPON ANY REPRESENTATION, WARRANTY OR OTHER ASSURANCE GIVEN OR MADE BY OR ON BEHALF OF CRICKET WIRELESS PRIOR TO THIS AGREEMENT AND YOU WAIVE ALL REMEDIES WHICH, BUT FOR THIS SECTION V, MIGHT OTHERWISE BE AVAILABLE TO YOU IN RESPECT OF SUCH REPRESENTATION, WARRANTY OR OTHER ASSURANCE.
- ALTHOUGH CRICKET WIRELESS INTENDS TO TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES OR OTHER DESTRUCTIVE MATERIALS TO THE PROGRAM WEBSITE AND THE MY CRICKET APPLICATION, CRICKET WIRELESS DOES NOT WARRANT, GUARANTEE OR MAKE ANY REPRESENTATIONS THAT THE PROGRAM WEBSITE AND MY CRICKET APPLICATION ARE FREE OF DESTRUCTIVE MATERIALS. IN ADDITION, CRICKET WIRELESS DOES NOT WARRANT THAT ACCESS TO THE PROGRAM WEBSITE AND MY CRICKET APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE, AND CRICKET WIRELESS ASSUMES NO RESPONSIBILITY FOR ANY LOSS OR DAMAGE CAUSED BY YOUR ACCESS, OR INABILITY TO ACCESS, THIS SITE.
- Limitation of Liability

- Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without reference to conflicts of law rules.
- Waiver. Any failure to enforce a term of this Agreement shall not be deemed a waiver of that term.
- Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall not be affected and shall remain valid and enforceable to the fullest extent permitted by law.
- Entire Agreement. The Agreement and documents incorporated by reference, including sections requiring dispute resolution by binding arbitration, constitute the entire agreement between us with respect to the Program.
